Terms of use
1. Agreement
Swanie Designs provides Swanie's GPS BOX. If you install the app, pair a phone, use a GPS BOX, pay for a plan, or use these pages, you agree to these terms. If you do not agree, do not use GPS BOX.
The manager is responsible for the box and for the people invited onto it. A member who joins agrees to these terms for their own phone.
2. What GPS BOX is
GPS BOX is a family locator. The phones are the GPS. A box at home stores the family's locations. It is a convenience for people who have agreed to share where they are. It is an aid. It is your job to know where your people are. We are not liable for a lost or missing person.
GPS BOX is not an emergency service, a monitoring center, a medical device, or a security company. A possible-crash notice tells the family. Nobody is called. In an emergency, a crash, or an injury, call 911. Do not wait for a notice from this app.
3. Location accuracy
Phone location is not under our control. GPS, cell towers, Wi-Fi, the map, the phone, the battery, and the network all affect what you see. A dot can be in the wrong place, late, or missing. Arrive, leave, check-in, speed, minutes away, battery, and crash notices can be wrong, late, or not sent at all. Speed and a possible crash are especially not guaranteed.
We do not promise that any location, time, speed, distance, or notice is accurate, complete, current, or fit for safety. Do not use GPS BOX for navigation, law enforcement, or any decision where being wrong could hurt someone.
4. The app may not work
We do not promise that the app, the box, house Wi-Fi, or the away-from-home plan will be available, uninterrupted, secure, or free of errors. A phone that is off, out of battery, missing location permission, or off the network will not share a useful place. Features can change or stop. A notice you expected may never arrive. Defects may not be fixed.
GPS BOX is provided "AS IS" and "AS AVAILABLE." Use is at your own risk. To the fullest extent the law allows, we disclaim every warranty, express or implied, including merchantability, fitness for a particular purpose, accuracy, timeliness, title, and non-infringement. Nothing we say outside these terms creates a warranty.
5. Who may use it
The manager must be an adult. If a person on the box is a child, the manager is their parent or guardian, or has that adult's permission. By adding someone, you represent that they agreed to share their location, or that you have the legal right to agree for them. Do not use GPS BOX to stalk, harass, or track someone unlawfully.
6. Your box and the plan
You own the box. Locations of people on that box stay on it. We do not keep a second copy of the map. On house Wi-Fi the phones talk to the box directly. Away from home, an active plan is required. If the plan lapses, away-from-home updates pause. The map at home can keep working.
One plan covers one GPS BOX, up to 8 phones, billed to the manager's email. That address is for plan notices. It is not shown on the map. Members join with a name. Prices can change. Cell-plan charges from your phone carrier are yours, not ours. You are responsible for the setup password and for who you invite.
7. The software
We give you a limited, personal, revocable license to use the app with your GPS BOX. You do not own the software. Do not copy it, sell it, or reverse engineer it, except where the law forbids that limit. Install the app from swaniedesigns.com. The map, the phone system, and the cell network are other people's services. Their failures are not ours.
8. Limitation of liability
To the fullest extent permitted by law, Swanie Designs and its developers, contractors, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or use. This includes injury, a missed or wrong location, a missed notice, a failure to reach someone, a missing person, or an inability to use the app or the box, whether or not we were told it might happen.
If a cap is allowed, our total liability for any claim about GPS BOX is the greater of (a) the amount you paid us for the GPS BOX plan in the 12 months before the claim, or (b) zero if you paid nothing. Some places do not allow these limits. In those places, liability is limited to the maximum the law allows.
9. Indemnity
You will defend and hold harmless Swanie Designs and its developers, contractors, and agents from claims, damages, losses, and reasonable attorneys' fees arising from your use of GPS BOX, the people you add, your breach of these terms, or your violation of someone else's rights.
10. Stopping
You can stop using GPS BOX at any time. We can change, pause, or end the app, the plan, or a feature, and we can refuse access if these terms are broken. If access ends, these terms still cover use that already happened.
11. Changes
We may change these terms by posting a new version on this page. If you keep using GPS BOX after that, you accept the new terms. If one part of these terms is not enforceable, the rest still applies.
